I don't see a problem here. Marijuana IS on a Federal Level Illegal. I don't use it, and I know that it impairs judgement

Unless you get your weed directly from the Federal Government (IND program), in which case you aren't breaking Federal law and therefore can truthfully answer "No".

The first form to fill out 'here' is, and has been, regarding the use of medical (or recreational) Marijuana, if you answer 'yes' to either one the whole process stops right then and there ... no moving forward, at all.

On Form 4473 the question is "Are you an unlawful user...". If you are in the IND program, the answer is NO, regardless of the "Warning". However, you could argue that the people in the program are "addicted", which is the second part of the question. They, in turn, could argue that marijuana doesn't usually create a physical addiction.
