Homeowner shoots intruder in home*invasion

A homeowner shot an intruder who was fleeing police after crashing a stolen tow truck late Tuesday, Tulsa police said.

Kenneth Shawn Harris, 31, was shot in both legs after allegedly breaking into the house in the 2500 block of East Marshall Street shortly after 11:30 p.m., Capt. Odom said.

Police believe he is the same man who was seen running from the tow truck after it crashed into an occupied SUV minutes earlier in the 1400 block of North Lewis Avenue, Odom said.

The truck was hauling a minivan, he said.

A police officer patrolling the area witnessed the wreck, Odom said.

When officers found Harris at the house, "they were able to piece those two different incidents together," he said.

Harris was taken to St. John Medical Center and was expected to be arrested on complaints of first-degree burglary, possessing a stolen vehicle and leaving the scene of an injury accident, Odom said.

The status of the minivan is unclear, but police confirmed that the tow truck was stolen, he said.

The homeowner was not injured.

Odom said the District Attorney's Office will review the shooting but that it appears the homeowner's actions were justified.

Oklahoma's "Make My Day" law allows residents to use deadly force against anyone who illegally forces their way into a residence.

"People have the right to use force to protect their property," Odom said.

Harris is set to be on probation until 2017 on drug possession convictions from 2005, records show.

He also has convictions of attempted burglary of a vehicle, knowingly concealing stolen property, possessing a stolen vehicle, grand larceny, larceny of a vehicle and pointing a gun.
